1. DEFINITIONS

      2. You will not rely on Output as a source of truth or factual information.

   3. Training & improvement

      To the extent permitted by law, you agree that your Input and any associated Output may be used (in anonymised or aggregated form where appropriate) to analyse, test, train and improve the Service, our AI models and related products.

      Where required by applicable law, we will provide you with appropriate choices or opt-out mechanisms regarding such use.

12. CREDITS, PAYMENTS & REFUNDS

    1. Credits

       Certain features of the Service require the purchase or use of Credits.
       Credits:

       • Are virtual units with no cash value;
       • Are non-transferable and may only be used on the Service;
       • Cannot be sold, traded or exchanged for money outside the refund scenarios described in these Terms.

    2. Prices

       • Prices for Credits are displayed clearly before purchase.
       • We may change prices at any time, but such changes apply only to future purchases and do not affect Credits you have already bought.

    3. Validity

       Unless otherwise stated on the Website, Credits are valid for 6 months from the date of purchase.

    4. 14-day consumer cancellation right (EU/UK consumers)

       If you are an EU/UK consumer, you may be entitled to a 14-day “cooling-off” period from the date of purchase.

       You may request a refund if:

       • The Credits have not been used at all, or
       • Only part has been used (you may receive a pro-rated refund for unused Credits).

       By purchasing Credits, you request and consent to the immediate supply of digital content. You acknowledge that once Credits are used, in whole or in part, your statutory right to cancel under applicable consumer law is lost for the portion of Credits consumed.
       To request a refund within 14 days, contact us at support@flingcircle.com with your account and purchase details.

    5. After 14 days

       After the 14-day period, unused Credits are generally non-refundable, unless:

       • Required by applicable law; or
       • We choose to make an exception at our sole discretion.

    6. Account termination & Credits

       • If you close your Account voluntarily, refunds are handled in accordance with Section 12.4 and applicable law.
       • If we permanently close the entire platform, we will provide a fair remedy for unused Credits in line with applicable law (for example, a refund or equivalent compensation).
       • If your Account is closed due to fraud, abuse or serious violations of these Terms, remaining Credits may be cancelled without refund where legally permitted.

    7. Chargebacks

       If you initiate a chargeback or otherwise reverse a payment without a valid legal basis, we may, to the fullest extent permitted by law:

       • Suspend or terminate your Account;
       • Invalidate any remaining Credits on your Account;
       • Seek to recover any administrative fees, costs or losses incurred by us as a result of the chargeback.

       This does not affect any statutory rights you may have.

13. LIABILITY

    1. Nothing in these Terms excludes or limits our liability for:
       • Death or personal injury caused by our negligence;
       • Fraud or fraudulent misrepresentation;
       • Any other liability that cannot be excluded or limited under applicable law.
    2. To the fullest extent permitted by law, we shall not be liable for:
       • Loss of profit, revenue or business;
       • Loss of data;
       • Loss of reputation or goodwill;
       • Emotional distress;
       • Any indirect, consequential or special damages.
    3. Subject to Section 13.1, our maximum total liability to you for all claims arising out of or in connection with the Service and these Terms (whether in contract, tort, negligence or otherwise) is limited to the higher of:
       • The total amount you paid to us for the Service (including Credits) in the 12 months immediately preceding the event giving rise to the claim; or £200.
    4. Any claim you may bring against us must be made within 12 months from the date you first became aware (or reasonably should have become aware) of the issue, failing which the claim is permanently time-barred.

14. TERMINATION

    1. You may close your Account at any time via your account settings or by contacting us at support@flingcircle.com
    2. We may suspend or terminate your Account or restrict your access to the Service if:
       • You breach these Terms;
       • You misuse the Service or violate applicable law;
       • We are required to do so by law, regulator, court order or payment provider;
       • We discontinue the Service (in whole or in part).
    3. Upon termination:
       • Your right to use the Service ends immediately;
       • We may deactivate or delete your Account and associated data in line with our Privacy Policy and legal obligations;
       • Credits will be handled in accordance with Section 12.

    1. These Terms and any dispute arising out of or in connection with them, the Service or the Website are governed by the laws of England and Wales, subject to any mandatory consumer protection laws in your country of residence.
    2. If you are a consumer in the UK or EU, you may bring legal proceedings in the courts of your habitual residence. We may only bring proceedings against you in the courts of your country of residence.

17. MISCELLANEOUS

    1. These Terms do not create any partnership, joint venture, employment or agency relationship between you and us.
    2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
    3. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights or obligations under these Terms without restriction, provided this does not reduce your statutory rights.
    4. A failure or delay by either party to enforce any right or provision under these Terms shall not constitute a waiver of that or any other right or provision.
    5. These Terms, together with the Privacy Policy and any other documents expressly referred to in them, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings.
    6. We may send you notices by email, via the Website, or through your Account. You are responsible for keeping your contact details up to date.
